A defectively designed product? Well, at least Robert Byers from Chicago thinks so, as he has filed a class-action suit against Microsoft in an Illinois federal court. The suit claims that Microsoft has been in such a hurry to gain market share, that they would have released a product which is actually faulty in design.

In more detail the lawsuit of Mr. Byers is about power supply and CPU overheating, thus making the device unstable. The lawsuit filed on last Friday seeks financial compensation as well as replacement or recall of the Xbox 360 game consoles. Microsoft is yet to comment

The proposed class action claims that in Microsoft’s bid to gain share in the $25 billion global video game market, the company was so intent on releasing the Xbox 360 before competing next-generation machines from Sony Corp. and Nintendo Co Ltd. that it sold a “defectively designed” product.

Robert Byers, who brought the suit, said the power supply and central processing unit in the Xbox 360 overheat, affecting heat-sensitive chips and causing the console to lock up.
